Representation at the Landlord and Tenant Board (LTB)

Applications, defences, and hearings before Ontario’s Landlord and Tenant Board.

The Landlord and Tenant Board is the administrative tribunal with exclusive jurisdiction over applications under the Residential Tenancies Act (RTA) – the legislation that sets out the rights and responsibilities of both landlords and tenants in Ontario. D&D Associates Paralegal Professional Corporation has represented Ontario landlords in matters before the Board for over 40 years.

How We Help

  • Eviction Applications: We prepare and file eviction applications on your behalf, from notice through to hearing.
  • Defending Tenant Applications: We represent landlords in responding to applications brought against them by tenants.
  • Above Guideline Rent Increase Applications: We prepare and pursue applications for rent increases above the provincial guideline where justified.
  • Timely, Compliant Filings: Because LTB matters are time-sensitive, we work diligently to avoid preventable delays and ensure every file meets the Board’s timelines.

We Help With All Forms, Applications, Claims and Defences at the LTB

The forms serve as notices to end a tenancy early based on a contravention of the RTA. We will help you fill out and file the related forms corresponding to your situation.

N4

Non-payment of Rent

N5

Interfering with Others, Damage or Overcrowding

N6

Illegal Acts or Misrepresenting Income

N7

Causing Serious Problems in Unit or on Premises

The applications are for landlords and are to be filed at the LTB. We will help you fill out and file the related application corresponding to your situation, adhering to the timelines and instructions stated within each.

Small Claims Court

Ask about our volume-based corporate fee schedule.

D&D Associates Paralegal Professional Corporation has assisted clients in many areas of the law, including unpaid accounts, damage claims, and negligence matters in Small Claims Court.

Monetary Jurisdiction of the Small Claims Court

The current limit of the Small Claims Court is $50,000.00. Many litigants choose to sue in Small Claims Court even if what they are owed is slightly higher than $50,000.00, as the cost to proceed in the higher court is greater and the process more time consuming.

We Provide the Following Services

  • Consultations
  • Preparation of demand letters
  • Preparation of Court documents, including Plaintiff’s Claims, Defences, and Notices of Motion
  • Representation at settlement conferences, trials, and motions
  • Enforcement of judgments and Board or Tribunal orders, including Notices of Garnishment, Examinations, and Writs of Seizure and Sale
  • Filing judgments and orders with a Credit Bureau
  • Skip tracing
  • Corporate searches
  • Driver’s licence and vehicle searches
  • Case law research

“Their vast knowledge, experience and hard work makes them great to work with.”

Defending Landlords Against Fire Code and Building Code Charges

Representation for landlords prosecuted under the Provincial Offences Act.

Municipal fire departments and building departments across Ontario actively inspect and enforce the Fire Code and Building Code, and a landlord who falls out of compliance can be charged and prosecuted under the Provincial Offences Act. These charges are frequently laid following a fire inspection, a building inspection, or a tenant complaint, and a conviction can carry significant fines. D&D Associates Paralegal Professional Corporation defends landlords through every stage of these prosecutions, from the first appearance to trial.

We review the charge or compliance order, assess the strength of the case against you, and identify the applicable defences, including due diligence and any procedural or technical issues with how the charge was laid.

How We Help

  • Fire Code Charges: Defending charges involving smoke and carbon monoxide alarms, fire separations, means of egress, fire safety plans, and other Fire Code requirements.
  • Building Code Charges: Defending charges related to unsafe or non-compliant structures, illegal or unpermitted renovations, and orders to comply issued by a municipal building department.
  • Property Standards: Representing landlords facing charges or orders under municipal property standards bylaws.
  • Court Appearances and Trials: Appearing on your behalf at every stage of the Provincial Offences Court process, including first appearances, pre-trials, and trials.

“Very helpful, extremely knowledgeable and supportive during challenging matters.”

Defending Landlords at the Human Rights Tribunal of Ontario

Representation for landlords facing an application before the HRTO.

Tenants may bring an application against a landlord at the Human Rights Tribunal of Ontario (HRTO) alleging discrimination under the Ontario Human Rights Code, whether in connection with a tenancy application, an existing tenancy, or the enforcement of a landlord's rights under the Residential Tenancies Act. These applications carry real consequences and require a prompt, well-prepared response. D&D Associates Paralegal Professional Corporation represents landlords through every stage of the HRTO process.

We understand that a Human Rights application can be stressful, particularly when it arises alongside or in response to Landlord and Tenant Board proceedings. Our paralegals will review the allegations, assess your position, and build a clear, well-supported defence grounded in the facts and the applicable law.

How We Help

  • Defending Applications: We review the tenant's application in detail, identify the issues in dispute, and prepare a thorough, evidence-based response on your behalf.
  • Filing Materials and Defences: We prepare and file all required responses, submissions, and supporting documentation with the Tribunal, ensuring every deadline is met.
  • Mediations: We attend mediations with you, working toward a fair resolution while protecting your interests throughout the process.
  • Hearings: When a matter proceeds to a hearing, we provide full representation, presenting evidence and argument on your behalf before the Tribunal.
Scope of Practice

What Can a Licensed Paralegal Do For You?

Since 2007, licensed paralegals in Ontario have been authorized to represent clients directly, independently of lawyers, within a defined and regulated scope of practice.

Once licensed by the Law Society of Ontario, a paralegal may represent clients at tribunals, in Small Claims Court, in traffic and Provincial Offences court, and in certain other proceedings, as well as provide legal advice and negotiate on a client's behalf. This defined scope keeps our focus narrow and our experience deep: we understand the procedures, timelines, and expectations of the tribunals and courts we appear before, and we put that specialized knowledge to work resolving your matter efficiently.

All licensed paralegals in Ontario are bound by the Law Society's Paralegal Rules of Professional Conduct, which set out the duties every paralegal must uphold in acting for a client.

Why Work With a Licensed Paralegal

  • Direct representation without needing to retain a lawyer
  • Specialized knowledge of tribunal and court procedure
  • A more cost-effective alternative to traditional legal counsel
  • Licensed and regulated by the Law Society of Ontario
  • Bound by a strict duty of confidentiality and integrity
  • Held to professional standards of competence and quality of service
